Terms & Condition

1. Booking and Payment:
   • A non-refundable deposit of 50% is required at the time of booking to secure your session date and time. The remaining balance is due on the day of the session.
   • Sessions are scheduled on a first-come, first-served basis. The deposit confirms your booking and is applied toward the total session fee.
     
     
2. Rescheduling and Cancellations:
   • If the client needs to reschedule, a 48-hour notice is required. The deposit will be applied to the rescheduled session, provided the new date is within 30 days of the original session date.
   • If the client cancels the session without rescheduling, the deposit is forfeited.
   • ‘Memories & You’ reserves the right to reschedule due to illness, emergency, or unforeseen circumstances. In such cases, the deposit will be transferred to a new session date.
     
     
3. Session Details:
   • The session will take place at the client’s home or studio location, as agreed upon during the booking process.
   • Only immediate family members are allowed to participate in the session unless prior arrangements have been made with the photographer.
     
     
4. Safety and Comfort:
   • The safety and comfort of the newborn is the top priorities. We will take every precaution to ensure a safe environment and will follow the baby’s cues to ensure their comfort.
   • The client is responsible for the immediate supervision of children other than the newborn being photographed.
   • ‘Memories & you’ reserves the right to terminate the session if they feel the safety of the baby is at risk or if instructions from the photographer are not followed.
     
     
5. Image Delivery and Editing:
   • The photographer will provide raw data within 3 days of the session, and the final edited images will be delivered within 1-2 weeks.
   • The client will receive professionally edited images in high-resolution digital format, as per the package they choose.
     
     
6. Copyright and Usage:
   • ‘Memories & you’ retains the copyright to all images taken during the session. The client is granted a personal use license to print and share images for non-commercial purposes.
   • ‘Memories & you’ reserves the right to use images for promotional purposes, including but not limited to the photographer’s portfolio, website, social media, and marketing materials. If the client wishes to opt out, they must notify the photographer in writing before the session.
     
     
7. Client Responsibilities:
   • In case of home shoot, client is responsible for ensuring that the session location is prepared and suitable for the shoot, with adequate natural light and temperature control.
   • The client agrees to cooperate fully during the session and follow all instructions provided by the photographer for safety and optimal results.
     
     
8. Liability:
   • ‘Memories & you’ is not responsible for any injuries, accidents, or damages that occur during the session unless they result from gross negligence or intentional misconduct by the photographer.
   • The client agrees to release the photographer from any claims or liability related to the session, including but not limited to personal injury, property damage, or loss.
     
     
9. Refund Policy:
   • Due to the custom nature of photography services, all sales are final. No refunds will be issued once the booking is confirmed.
     
     
10. Governing Law:
    • These terms and conditions shall be governed by and interpreted in accordance with the laws of G.B Nagar (UP).
    • Any disputes arising under or in connection with these terms will be subject to the exclusive jurisdiction of the courts of G.B Nagar (UP).
      
      
11. Agreement:
    • By booking the newborn photography session, the client agrees to these terms and conditions.
